The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. We make no guarantees to the item being complete, in working order or any guarantee of the above.
BUYERS PREMIUM: A 15% Buyer's Premium (additional 3% for credit cards) will be added to all purchases. If you bid $100.00 at check out you will be charged $115.00.
SALES TAX: State & City (if applicable) sales tax will be added to your invoice. If you are claiming an exemption from sales tax for Ag or Resale, please complete a Nebraska Form 13 unless the auction company has one on file.
PAYMENT: Cash, check, or credit card payments can be collected at checkout. You may also pay online with a credit card. Payment must be made prior to picking up items. Sales tax will be charged where applicable. Payment must be made prior to the end of load out. Failure to do so will result in your card you registered with being charged, forfeiture of your items (unless arrangements have been made prior end of load out for shipping), and possible ban from future online auctions.
CREDIT CARD: You will need to add a credit card to your account to bid. This is used to verify your account and to keep fake bidders from bidding against you. Auction company conducts a $1 authorization on your card to verify funds available. This is just a hold, no money is removed from your account. Auction company releases this hold 4-7 days after the auction.
CREDIT CARD CHARGEBACKS: Under no circumstances does a registered bidder have authority to chargeback on their credit card for purchase. You 100% agree to the terms listed here. You as a bidder understand and agree that your credit card may be charged for your full purchase price, buyer premium, fees, taxes or shipping. It does not matter whether you receive your items or not. You agree that all items are sold as-is where is and you accept the condition they are in. There are absolutely no refunds regardless of anything.
TITLES: Titles will be mailed to buyer within 14 business days of items being paid for and picked up. NO EXCEPTIONS.
GUNS: All gun purchasers must provide a Nebraska CCW Permit or Nebraska Firearm Purchase Permit and complete a form 4473 for transfer. Out of State buyers can pick up a long gun and must pass a NICS background check. But, if the background check comes back to wait or declined, you are still liable for full payment. The gun can then be resold on our next auction minus regular commission charges.
INSPECTION/PREVIEW: Inspection during the posted times ONLY.
STAGGERED/DYNAMIC CLOSING: The auction will begin closing at 6:00pm Central Standard Time at a rate of 6 lots per minute. The closing time of each lot will be automatically extended back to 3 minutes whenever a bid is placed within the last 3 minutes of any lot.
SHIPPING & HANDLING: Shipping is available on small, shippable items. We do NOT ship furniture or large items. A $10 Handling fee will be added to each S&H invoice in addition to the 3% convenience fee for electronic payment. We will NOT ship outside of the U.S. We do not accept e-mailed shipping labels. We will NOT ship outside of the U.S. Items will be shipped either USPS or UPS, whichever is cheaper. We do not accept e-mailed shipping labels. NO EXCEPTIONS!
LOAD OUT: Winning Bidders must pick their items during the specified load out times. Any items left after the specified load out date will be considered forfeited. We will not be offering any additional load out dates or times. It will be the buyer's responsibility to dismantle & disconnect any and all equipment. Please bring your own packing materials, labor, tools & moving equipment. Some items may be in the basement! All Buyers will be required to sign a hold harmless/liability waiver prior to loading. DO NOT BID IF YOU DO NOT WANT YOUR ITEMS SHIPPED OR CANNOT ATTEND THE SCHEDULED PICK UP TIMES!!
CAUTION: For demonstration purposes various equipment may be joined. Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions.
CATALOG DISCREPANCIES: You are bidding on the described item not the photograph, occasionally the wrong photo may be displayed, always read the item description. Server & Software Technical Issues: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, Schultis & Son, Inc. Real Estate & Auction Service reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE NOR SCHULTIS & SON, INC. REAL ESTATE AND AUCTION SERVICE SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON.
WARRANTY & CONDITION OF ITEMS SOLD: All items are sold 'AS IS, WHERE IS', with NO WARRANTY expressed or implied. It is the responsibility of the buyer to determine the condition of the items and bid accordingly. Descriptions are believed to be accurate but not guaranteed. When you are not certain of the condition or use of an item please bid accordingly. The auctioneer reserves the right to add or remove items from the auction; split or combine lots; add minimum bids or reserve prices; cancel, suspend, extend or reschedule an individual item or auction event. The auctioneer reserves the right to make changes to the auction closing times or inspection or removal times.
